1 - SCOPE

These terms and conditions of sale are systematically presented to each Buyer when placing an order. They apply to all creations offered for sale on the website catherine-lanoe.fr and are reserved for Buyers who are legally capable of entering into contracts regarding the goods and services offered on the site. Consequently, placing an order implies full and unconditional acceptance of these terms and conditions of sale, as well as the applicable pricing. These conditions take precedence over any other document, including the Buyer's own terms of sale. Any contradictory condition set by the Buyer will not be enforceable against Catherine LANOË, unless expressly accepted, regardless of when it may have been brought to her attention. Any failure by Catherine LANOË to enforce any provision of these terms and conditions shall not be construed by the Buyer as a waiver of these terms. These terms may be updated or amended without notice. The applicable terms will be those in effect at the time of the contract's conclusion, i.e., on the day the order is recorded.

2 - ACCEPTANCE OF THE TERMS AND CONDITIONS OF SALE

By ticking the box "I have read and accept the Terms and Conditions of Sale" (or any other equivalent wording), the Buyer accepts these Terms and Conditions of Sale, acknowledges that they are fully understood, and waives the right to rely on any other terms.

3 - PRODUCT CHARACTERISTICS

In accordance with Article L.111-1 of the French Consumer Code, the Buyer may, prior to placing an order, view the essential characteristics of the creations, whether art postcards or original works (watercolour paintings, original numbered engravings, ink drawings with watercolour, and pastels), on the website. Catherine LANOË endeavours to present these characteristics as accurately as possible on each product page. The photographs and text used to illustrate the items are for reference only and are not contractually binding. Although the items are represented on the site as precisely as possible, there may be slight variations in tone in the photos. In such cases, Catherine LANOË cannot be held liable. Catherine LANOË offers unique original paintings, which are photographed with precision, as well as art postcards and other creations, whose visual description is as close to reality as possible.

4 - ORDER

In accordance with the Law of 13 March 2000 on electronic signatures and the Law on confidence in the digital economy of 21 June 2004, any order validated by the Buyer's "double click" constitutes an irrevocable acceptance of these terms and conditions by the Buyer, equivalent to a handwritten signature, and cannot be revoked. To place an order on the website, the Buyer must:

  • Identify themselves;
  • Complete the order form;
  • Review the order summary;
  • Correct any errors in the order;
  • Confirm the order (double-click confirmation).

The validation of the order constitutes express acceptance of all transactions made on the website. The sale is only considered final after Catherine LANOË has sent the Buyer an order confirmation by email and the full price has been paid. Catherine LANOË cannot be held responsible for any errors made by the Buyer (e.g., incorrect contact details, creation references, quantity) that result in delays or mistakes in delivery. In such cases, the Buyer may not make any claims against Catherine LANOË.

5 - PRODUCT AVAILABILITY

The availability of art postcards is subject to stock levels. In the case of special orders (large quantities, art prints), a printing time may be required in agreement with Catherine Lanoë, who will inform the customer to confirm this. Orders are processed in the order they are received, with an average processing time of 3 business days (unless otherwise indicated by Catherine Lanoë). Catherine Lanoë cannot be held liable in the event of a stock shortage at her printer, in cases of force majeure, or in the event of full or partial strike action, particularly by postal services and transport providers. Force majeure events, releasing Catherine Lanoë from her obligation to deliver, include disasters, administrative decisions, natural catastrophes, war, riots, fire, flooding, accidents, and communication breakdowns (such as network outages). Catherine Lanoë will inform the Buyer in a timely manner of any such occurrences.

6 - PRICES

Prices are listed in euros (€) and apply only as of the date the order confirmation is sent to the customer. The price indicated in the order confirmation is the final price, inclusive of all taxes (VAT not applicable, Article 293B of the French General Tax Code for France and EU countries). Prices do not include shipping and packaging costs, which are billed additionally and vary depending on weight and destination. These are automatically calculated at the time of ordering. The seller reserves the right to modify prices at any time.

7 - PAYMENT TERMS

The total price is payable in a single instalment, as follows:

  • Credit Card via STRIPE: secure payment.

8 - DELIVERY

Delivery is generally carried out by La Poste Colissimo tracked service, or by Chronopost for some parcels within mainland France. Delivery times are indicated as accurately as possible. Any delays in delivery do not entitle the Buyer to claim damages. Unless otherwise stated in these Terms and Conditions, delivery costs are always borne by the Buyer. If a parcel is returned to me due to an error on your part (incorrect address, failure to collect, no letterbox, wrong name, etc.), the return shipping costs will be charged to you. These fees must be paid by cheque before the parcel is re-sent.

9 - SHIPPING COSTS

 

 

10 - LIABILITY

I take care to prepare your orders with attention, taking into account the fragility of the creations, using appropriate and sturdy packaging. Upon receipt of your order, if the parcel is damaged, please notify me by email at contact@catherine-lanoe.fr on the day of delivery (or the next working day), attaching photos of the damaged items. I will contact you to find a satisfactory solution. Any claims made after this period will not be accepted, and I will not be held liable. I reserve the right to request the return of damaged creations for a possible exchange (subject to the legitimacy of the Buyer's claim).

If the customer is not completely satisfied with their order or simply changes their mind, under Articles L.121-20 and following of the French Consumer Code and the new Hamon law on e-commerce, they have a period of fourteen (14) days to exercise their right of withdrawal without providing reasons or incurring penalties, except for return shipping costs. The above period starts from the date the creations are received. The right of withdrawal applies only to the return of the creations in their original condition and packaging, accompanied by the corresponding invoice and the Buyer's bank account details (RIB). The customer may return the items at their own expense using the withdrawal form provided and request a refund (excluding delivery costs). The return of goods is at the customer's own risk. Catherine LANOË agrees to refund the returned items within 30 days of receiving them. Alternatively, the customer may request an exchange instead of a refund by specifying this on the returned invoice. The exchange or refund will only be processed after Catherine LANOË verifies the quantity and quality of the returned items. Postcards must be in their original packaging, in perfect condition, and original paintings must be free from any marks, folds, or stains on the paper or support.

12 - RESERVATION OF TITLE AND TRANSFER OF RISK

Ownership of the creations will only pass to the Buyer upon full payment of the price, regardless of the delivery date. However, the transfer of risk occurs when the creation is handed over to the carrier.

13 - DATA PROTECTION

The information requested from the Buyer is necessary to process and fulfil the order and may be shared with partners involved in processing the order (e.g., the postal service). This information is kept confidential and protected in compliance with the General Data Protection Regulation (GDPR) and will not be disclosed to third parties for commercial purposes. The Buyer has the right to access, correct, or delete their data.

15 - DISPUTE

These terms and conditions of sale are subject to French law. Any dispute arising from the interpretation or performance of these terms shall fall within the exclusive jurisdiction of the competent courts of the Seller's registered office, notwithstanding multiple defendants or third-party claims.

16 - INTELLECTUAL PROPERTY

All content on the site (texts, photographs, paintings, graphics, etc.) are protected by copyright. They are the exclusive property of Catherine LANOË, and no part of the site may be copied or used without permission.
